According to the ASA’s Code for gambling advertising, anyone who “was, or seemed to be, under 25 years of age” must not be depicted gambling or playing a significant role in advertisements. 

The regulator concluded that the central figure’s youthful facial features, casual styling and excited demeanour gave the impression he was in his late teens or early twenties. 

As such, the ad violated rule 16.3 of the CAP Code (Edition 12).

The city council legalised VGTs in its latest budget that took effect in January. Mayor Brandon Johnson opposed the move but was overruled by a council majority. Johnson and his colleagues have fought over the issue all year, which is still largely unresolved.

The mayor has not opined this summer, at least publicly, on if he believes Bally’s will open the casino in the first quarter of 2027. The huge structure, measuring nearly 140 feet long and 20 feet tall, was installed Friday, September 18, as part of the second expansion of Station Casinos’ Durango property.

Suffolk Construction, the project’s general contractor, used a crane weighing roughly 650,000 pounds for the lift, with a second crane assisting with the operation.

Durango opened in December 2023 following an impressive $780 million development. The property completed its first $120 million expansion in December 2025, and work on the latest project began in January 2026.
